General sales conditions

1. Registration

Registration is not required to purchase from the Yasenka online store. However, if you prefer not to enter your shipping address and payment information with every purchase, registration is recommended. To register, simply provide a valid email address, personal information (name, surname, address, postal code, city, telephone number), and any password for your user account. It is advisable to use a combination of uppercase and lowercase letters.

After entering this information, complete the registration by clicking the “Register” button. Your account will remain active in the system, and you can access it by entering your username and password on the “Login” page. For each subsequent purchase, you will only need to enter your username and password.

If you forget your password, click on “Forgot your password?” on the same page. You will need to enter your registered email address, and the system will automatically send you a link to reset your password. You can change your password later in your account settings.

2. Ordering

Goods can be ordered through the online store, which is open for orders at all times. Orders are processed on weekdays from 8:00 a.m. to 4:00 p.m. CET.  To complete the payment and delivery of the desired products, the buyer must fill in the necessary fields regarding the recipient’s details and address. The buyer will receive an email confirming the completed order.

Step 1: The shopping cart page displays the products you have added while browsing. To remove an item, click the “Remove from Cart” link next to the item. To confirm your purchase, click the “Proceed to Payment” button.

Step 2: The buyer completes the order by entering all required information (name, surname, address, telephone number, email address) in the form on the website. Click the “Proceed to Checkout” button to finalize your order.

Step 3: If the order is successfully completed, the customer will see the message “Thank you for your order” on the website. The buyer will also receive a message with the order details at the email address provided.

Yasenka d.o.o. commits to delivering all ordered products that are in stock at the time of delivery. If Yasenka d.o.o. cannot deliver any ordered products, it will contact the customer via phone or email.

3. Prices and delivery

Prices are retail, expressed in euros and include VAT. The product will be delivered within 6-10 working days of receiving your order, if available. Exceptions are pre-orders or special promotions. Delivery is charged according to the price list agreed with the DPD delivery service. Shipping and packing costs are charged separately and are visible on the invoice.

5. Statement on the security of online payments

The CorvusPay system ensures complete confidentiality of your card and personal data from the moment you enter them into the CorvusPay payment form. Payment information is transmitted encrypted from your web browser to the bank that issued your card. Our store never comes into contact with your complete payment card details.

Also, the data is inaccessible even to employees of the CorvusPay system. An isolated core independently transfers and manages sensitive data and keeps it completely secure.

The payment data entry form is equipped with an SSL transport code of the highest reliability. All stored data is further protected by encryption using a cryptographic device certified to the FIPS 140-2 Level 3 standard.

CorvusPay meets all the requirements regarding the security of online payments prescribed by the leading card brands, i.e. it works in accordance with the standard – PCI DSS Level 1 – the highest security standard of the payment card industry. When paying with cards included in the 3-D Secure program, in addition to the validity of the card itself, your bank additionally confirms your identity with a token or password. Corvus Pay treats all information collected as confidential and handles it accordingly. The data is used exclusively for the purposes for which it is intended. Your sensitive data is completely safe, and its privacy is guaranteed by the most modern security mechanisms. Only the data that is necessary to perform the work in accordance with the prescribed demanding procedures for online payment is collected.

The security controls and operational procedures applied to our infrastructure ensure the current reliability of the CorvusPay system. In addition, by maintaining strict access control, regular security monitoring and in-depth checks to prevent network vulnerabilities, and planned implementation of information security provisions, they permanently maintain and improve the level of system security by protecting your card data.

6. Order Cancellation

If you wish to cancel your order, please do so as soon as possible, preferably between Monday and Friday from 8:00 a.m. to 4:00 p.m. CET. You can email us at info@yasenka.ie at any time.

7. Impossibility of delivery by the seller

If the seller cannot deliver the product because the ordered item is out of stock or cannot be obtained from the supplier, the seller will notify the buyer by email. The buyer can then either cancel the order or accept a new delivery date.

If the consumer chooses to cancel the order, the seller will refund the amount paid as soon as possible, but no later than 30 days after the delay, plus the prescribed interest rate.

8. Impossibility of delivery by the seller in cases of promotion and high demand for the product

In cases of significant promotions and special offers that lead to high product demand, the seller will notify the buyer in writing about the order cancellation and the impossibility of concluding the contract due to the inability to deliver the product.

These situations arise when the buyer has completed the order but has not made payment or confirmed the purchase, as well as in cases where the buyer chooses to pay by card (in which case payment will not be processed).

9. Termination of the contract

You may unilaterally terminate the contract within 14 days without providing a reason. To exercise this right, you must notify us of your decision before the end of the 14-day period through an unequivocal statement sent by post or email, including your name, address, telephone number, and/or email address. You may also use the FORM FOR UNILATERAL TERMINATION OF CONTRACTS (Article 33 of the Consumer Protection Act). The 14-day period begins when you receive the products along with a cancellation form.

If you unilaterally cancel this contract within the specified period, in accordance with Article 76 of the Consumer Protection Act, the merchant is obliged to refund the entire amount paid by the consumer under the contract no later than 14 days from the receipt of the written withdrawal notice. The refund will be processed using the same method as the original payment, or another mutually acceptable method. You will not incur any additional costs related to the return. Refunds can only be made after the goods are returned to us and their condition has been verified. We do not accept cash-on-delivery returns.

The consumer does not have the right to cancel the contract if it pertains to the sale of goods that, due to their nature, cannot be returned or are subject to rapid deterioration.

10. Product return

You can return or send the goods to the address: Yasenka d.o.o. (Customer Service), Dvanaest redarstvenika 2 / c, 32000 Vukovar, Croatia without undue delay and no later than 14 days from the day you sent us the decision on unilateral termination of the contract.

In case of contract termination, the consumer is obliged to return the product to the trader at their own expense (second paragraph of Article 48 of the Consumer Protection Act). You are responsible for any impairment resulting from handling the goods beyond what is necessary to determine their nature, characteristics, and functionality.

Goods may only be returned if they are unused and packaged with all parts and documentation (a valid receipt is required as proof of purchase)

11. Complaints

If you have a complaint about the delivered product, write to us at info@yasenka.ie. The buyer is obliged to keep the invoice.

We guarantee that the product will function properly when used in accordance with the instructions provided. In the event of errors, we undertake to replace the product within a reasonable time in accordance with the Obligations Act.

12. Objections

Written complaints can be sent by mail or delivered in person to the address Yasenka d.o.o., Dvanaest redarstvenika 2 / c, 32000 Vukovar with the label “For the Yasenka.ie online store” or to the email address info@yasenka.ie.

13. Warranties

Yasenka d.o.o. does not warrant or guarantee the accuracy of the information, nor does it accept any damages or other liability for errors or omissions in the content of the published offer.

14. Use of the product

You use the purchased products at your own risk and cannot be considered a substitute for medical or nutritional therapy.

15. Alternative resolution of consumer disputes

As of February 15, throughout the European Union, you have the right and opportunity to resolve disputes related to online shopping easily on this website. The European Commission has created a platform for such dispute resolution accessible to all EU citizens.

The platform is designed for the alternative (out-of-court) resolution of domestic and cross-border disputes arising from sales or service contracts between traders based in the Republic of Croatia and consumers residing in the EU, in proceedings before alternative authorities (ARPS authorities) authorized to mediate or make non-binding or binding decisions on disputes.

When consumers and traders file a complaint, dispute resolution bodies will act as mediators to resolve the issue.

Once an agreement is reached on who will resolve the dispute, the platform automatically forwards the case to that body, which is required to resolve it entirely online within 90 days.

From February 15, throughout the European Union, you have the right and the opportunity to resolve disputes related to online shopping in just a few clicks on this website. The European Commission has created a platform for such dispute resolution that is accessible to all citizens of the European Union.

The platform is intended for the alternative (out-of-court) resolution of domestic and cross-border disputes arising from sales contracts or service contracts between traders based in the Republic of Croatia and consumers residing in the European Union (hereinafter: EU) in proceedings before alternative authorities. resolution of consumer disputes (hereinafter referred to as: ARPS authorities), which are authorized to carry out conciliation or make a non-binding or binding decision on the dispute.

When consumers and traders file a complaint, dispute resolution bodies will act as mediators between the two parties to resolve the issue.

Once an agreement is reached on who will resolve the dispute, the platform automatically forwards the dispute to this body, which is required to resolve the dispute in its entirety over the Internet within 90 days.

The online platform for online alternative dispute resolution has been available here since February 15, 2016,  to all citizens of the European Union.

16. Judiciary

These Terms of Use will be governed by and construed in accordance with Croatian law, without regard to conflict of law provisions. Croatian legislation will apply to all legal disputes that may arise from the Agreement. You further agree to submit to the Croatian courts, and any legal action you take shall be subject to the exclusive jurisdiction of the Croatian courts.

The failure of Yasenka d.o.o. to enforce any rights or provisions of these terms does not constitute a waiver of those rights. If a competent court finds any provision or claim invalid, the parties agree that the court will strive to give effect to the parties’ intentions as reflected in the provision, and the remaining provisions will remain in full force and effect.
